Property Demolition: Absence of Hon Abiru Stalls Trial, Court Adjourns To October 23

In what seems like a deliberate attempt to frustrate the claimant and evade justice, Chief Whip of the Lagos State House of Assembly, Hon. Rotimi Abiru was absent for the second time at the hearing of a case on demolition of property proffered against him by High Chief Kehinde Kalejaiye before Justice Alakija at the Lagos High Court sitting in Lagos on June 19, 2019.

High Chief Kalejaiye had dragged Hon Abiru, lawmaker representing Somolu constituency 11 at the Lagos State House of Assembly to court over unlawful demolition of his property.

But after the first hearing, Counsel to Hon Abiru, Barr Mubarak Abdullahi prayed the court for the adoption of Compulsory Management Committee, CMC.

The judge thereafter  adjourned to June 19 and requested for physical presence of Hon Abiru.

At the resumed hearing yesterday, June 19, Counsel to Hon. Abiru, Barr Osinusi Subomi told the court that his client was on an official assignment hence his absence at the court.

This stalled proceeding and Justice Alakija ruled that  both the claimant and defendant must be present during CMC.

Speaking to newsexplorersng.com, Barr Subomi said his client is a busy politician, adding that, the case at hand is a distraction to his busy schedule.

He added that  Hon Rotimi Abiru is busy with legislative works at the State Assembly and this explained his absence at the  the court.

He argued that the case at hand is a distraction to his client’s busy schedule, he informed that the court has adjourned to October 23 and hoping that his client would honour the court’s invite.

Consequent to this, the claimant, High Chief Kalejaiye has described the deliberate absence of Hon. Abiru from the trial as arrogant and a total disrespect to the judiciary and rule of law.

High Chief Kalejaiye stated this in a brief interview with our correspondent after the court hearing.

He said, “This is a total disrespect to the judiciary and the rule of law. It is an act of arrogance to the court. In fact, I can’t comprehend why a law-maker would intentionally disregard a court order.

This is disheartening. Hon Abiru has again proved to Nigerians that he is above the law. And I can only say, he is conscious of his wrong doing, reason he is trying to evade the long arm of the law.

As a law abiding citizen, I am committed to ensuring that justice is served. I seek justice for my property he demolished and he must be made to answer for his misuse of state power and government agency.”

Meanwhile, Counsel to high Chief Kalejaiye, Barr Kayode Ajala has reaffirmed his trust in the judiciary as the last hope of the oppressed.
He said, he is confident that justice will be served in due cause.
